1. Agreement to Terms

These Terms and Conditions ("Terms") are a legally binding agreement between you and Pebbii Ltd ("we", "us", or "our"), a company registered in England and Wales, governing your use of the Pebbii Journal mobile application ("App") and related services (the "Service").

By using the App you agree to these Terms. If you do not agree, do not use the Service.

2. Definitions

  • Content: journal entries, text, images, and other material you create or upload through the Service.
  • Shared Journal: a collaborative journal space where multiple users contribute entries.
  • Reveal Mechanic: the feature that prevents members from viewing each other's entries until they submit their own response.

3. Eligibility

You must be at least 13 years old to use the Service. Users aged 13–17 must have parental or guardian permission. You are responsible for providing accurate registration information.

4. Accounts

You sign in via a supported third-party provider (Google, Apple, or email). You are responsible for all activity under your account. Notify us immediately of any unauthorised access.

You may delete your account at any time in App settings. Deletion requires re-authentication to confirm. Your Content is permanently removed from our systems within 90 days, except where retention is required by law. Content already revealed to other shared journal members may remain visible to them.

5. The Service

Pebbii Journal provides:

  • Daily curated journal prompts
  • Personal and shared journal spaces with the reveal mechanic
  • Optional location tagging for entries
  • Premium features including AI-generated prompts, streak tracking, and family plans

We may modify or discontinue features at any time, with reasonable advance notice for significant changes.

6. Subscriptions and Payments

The Service offers free and premium subscription tiers. Premium subscriptions are billed through the Apple App Store or Google Play Store and renew automatically unless cancelled at least 24 hours before the renewal date.

Subscription management and cancellation must be done through your app store account settings. Refunds are subject to the policies of the Apple App Store or Google Play Store.

7. Your Content

You retain ownership of all Content you create. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, copy, and display your Content solely to operate and improve the Service.

You are responsible for your Content. You warrant that it does not infringe third-party rights, violate any law, or contain harmful code.

In a shared journal, other members may view your entries after they submit their own. You cannot control what members do with that information outside the App.

8. Prohibited Conduct

You agree not to:

  • Violate any applicable law or regulation
  • Upload content that is defamatory, obscene, threatening, or hateful
  • Impersonate any person or entity
  • Attempt to gain unauthorised access to the Service or other accounts
  • Use automated tools (bots, scrapers) to access the Service
  • Reverse engineer or extract source code from the App
  • Use the Service for commercial purposes without our written permission

9. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Pebbii Ltd and protected by applicable intellectual property laws. You may not copy, modify, distribute, or sell any part of the Service without our written permission.

10. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Third-Party Services

We use third-party providers for authentication, push notifications, storage, payments, and AI features. Your use of these services is subject to their own terms. We are not responsible for third-party content or practices. A list of key providers is in our Privacy Policy.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEBBII LTD IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the greater of £100 or the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify Pebbii Ltd against any claims, damages, or expenses arising from your violation of these Terms, your use of the Service, or your Content.

15. Termination

We may suspend or terminate your account for breach of these Terms. Provisions that by nature survive termination (ownership, warranties, indemnity, liability) remain in effect.

16. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales. Before initiating legal proceedings, please contact us first to attempt informal resolution.

17. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by email or through the App. Continued use constitutes acceptance.

18. General

If any provision is found unenforceable, the remainder of these Terms continues in full force. Our failure to enforce a right is not a waiver of that right. These Terms, together with our Privacy Policy, constitute the entire agreement between us.
