1. Agreement to Terms

These Terms and Conditions ("Terms") are a legally binding agreement between you and Pebbii Ltd ("we", "us", or "our"), a company registered in England and Wales, governing your use of the Pebbii mobile application ("App") and related services (the "Service").

By using the App you agree to these Terms. If you do not agree, do not use the Service.

2. Definitions

  • Content: journal entries, text, images, and other material you create or upload through the Service.
  • Shared Journal: a collaborative journal space where multiple users contribute entries.
  • Reveal Mechanic: the feature that holds members' answers to a shared journal's daily prompt until every member has answered or skipped it, and then shows them only to members who answered. It can be switched off in a journal's settings, in which case a member sees the others' answers once they have answered themselves.

3. Eligibility

You must be at least 13 years old to use the Service. Users aged 13–17 must have parental or guardian permission. You are responsible for providing accurate registration information.

4. Accounts

You sign in with Apple or Google. We never receive your provider password. You are responsible for all activity under your account, and you should notify us immediately of any unauthorised access.

You may delete your account at any time in App settings. Deletion requires re-authentication to confirm. Your Content is permanently removed from our systems within 90 days, except where retention is required by law. Content already revealed to other shared journal members may remain visible to them.

5. The Service

The Service includes, at no cost:

  • Daily curated journal prompts
  • Personal and shared journal spaces with the reveal mechanic
  • As many journals as you wish, of any type, and joining any journal you are invited to
  • Sync and backup across your devices
  • Optional location tagging, and entries started from an iOS Journaling Suggestion
  • One photo per entry
  • Streak tracking, and the figures on your weekly, monthly and yearly summaries
  • A plain export of your data
  • An optional Face ID or passcode lock on the App

A Premium subscription adds:

  • Adding a third or further member to a journal you own. The subscription is required from the journal's owner, never from the person being invited.
  • Up to thirty photos per entry
  • AI features: personalised prompts, writing hints, rewriting an entry in a different tone, and the written narrative on your weekly, monthly and yearly summaries
  • "On this day" reminders of what you wrote on the same date in earlier years

We may modify or discontinue features at any time, with reasonable advance notice for significant changes. If a limit changes, content you have already created is not deleted or trimmed to fit the new limit.

6. Subscriptions and Payments

The Service offers a free tier and a Premium subscription. Premium is sold as an in-app purchase through the Apple App Store, on a monthly plan, a yearly plan, or a yearly family plan. All of them renew automatically unless cancelled at least 24 hours before the renewal date.

The family plan can be shared through Apple Family Sharing, which gives the members of your Family Sharing group the same Premium features. Family Sharing is operated by Apple and is managed in your Apple account rather than in the App.

Subscription management and cancellation must be done through your App Store account settings. Refunds are subject to Apple's policies.

7. Your Content

You retain ownership of all Content you create. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, copy, and display your Content solely to operate and improve the Service.

You are responsible for your Content. You warrant that it does not infringe third-party rights, violate any law, or contain harmful code.

In a shared journal, other members can see your entries: answers to a daily prompt as the Reveal Mechanic allows, and entries not written for a prompt straight away. Members who join later can see the journal's earlier entries. You cannot control what members do with that information outside the App.

Some features send part of your Content to our AI provider so that a result can be returned to you, for example rewriting an entry or writing a summary narrative. Section 5 of our Privacy Policy lists exactly what each feature sends. AI output is generated automatically, may be inaccurate, and is not advice of any kind.

8. Prohibited Conduct

You agree not to:

  • Violate any applicable law or regulation
  • Upload content that is defamatory, obscene, threatening, or hateful
  • Impersonate any person or entity
  • Attempt to gain unauthorised access to the Service or other accounts
  • Use automated tools (bots, scrapers) to access the Service
  • Reverse engineer or extract source code from the App
  • Use the Service for commercial purposes without our written permission

9. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Pebbii Ltd and protected by applicable intellectual property laws. You may not copy, modify, distribute, or sell any part of the Service without our written permission.

10. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Third-Party Services

We use third-party providers for authentication, push notifications, storage, payments, and AI features. Your use of these services is subject to their own terms. We are not responsible for third-party content or practices. A list of key providers is in our Privacy Policy.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEBBII LTD IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the greater of £100 or the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify Pebbii Ltd against any claims, damages, or expenses arising from your violation of these Terms, your use of the Service, or your Content.

15. Termination

We may suspend or terminate your account for breach of these Terms. Provisions that by nature survive termination (ownership, warranties, indemnity, liability) remain in effect.

16. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales. Before initiating legal proceedings, please contact us first to attempt informal resolution.

17. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by email or through the App. Continued use constitutes acceptance.

18. General

If any provision is found unenforceable, the remainder of these Terms continues in full force. Our failure to enforce a right is not a waiver of that right. These Terms, together with our Privacy Policy, constitute the entire agreement between us.
